Court Proceedings and litigation

Court can be stressful and expensive. However, it is also necessary and unavoidable at times. We understand the effects of court proceedings and our goal is to ease you through these difficult times.

It is important to remember, however, the processes for initiating court may be different in different circumstances such as: what the issues are and whether you’ve already been in court, had an agreement or a final order. We are here to provide you advice on court proceedings and advocate for your rights at the Ontario Court of Justice and Superior Court of Justice.

If you are disputing an existing Order, this may mean proceedings at the appellant courts as well. Our office can guide you through the complex processes of Appeals for final or temporary Orders.

Domestic Contracts

Most are familiar with Separation Agreements and Cohabitation Agreements. Our office is well versed with the tools to provide negotiation to settle all issues during the separation process.

However, aside from Separation Agreements, at any time after deciding to enter into a marriage or cohabitation partnership, you and your spouse or partner can agree to the terms of the marriage or partnership through a Marriage Contract (otherwise called “prenuptial agreement” or “prenup”) or Cohabitation Agreement.

It may be a good idea to outline the terms of your relationship with your partner and our team is here to help in explaining what can and cannot be included in such contracts as well as the drafting and execution of such agreements.

Wills and Estate Planning

Note on Will kits: Will kits are increasingly becoming more popular among individuals. While these may seem cheaper and less cumbersome than hiring a lawyer to complete your Estate Planning, please consider that these kits often do not account for legal intricacies, and they largely ignore important details.

Do not leave your loved ones in a position in which they have a lengthy court process after your death because of an inadequate Will Kit.

Immigration Law

Some of the key objectives of the Immigration Refugee Protection Act are, but are not limited to:

  • to reunite families (Immigration and Refugee Protection Act, s. 3(1)(d));
  • to “facilitate the entry” into Canada of visitors, students, and temporary works (Immigration and Refugee Protection Act, s. 3(1)(g)); and,
  • “to permit Canada to pursue the maximum social, cultural and economic benefits of immigration” (Immigration and Refugee Protection Act, s. 3(1)(a)).

The Canadian immigration Act also includes positive objectives towards refugee claimants, including but not limited to, “recognizing that the refugee program is in the first instance about saving lives and offering protection to the displaced and persecuted” (Immigration and Protection Act, s. 3(2)(a)).
